(4) Medical Disability Leave of Absence for Non-Occupational Disabilities
A medical disability leave of absence (LOA) may be granted for non-work related temporary medical disabilities (other than pregnancy, childbirth, and related medical conditions) for up to twelve (12) weeks within a calendar year, with a doctor’s written certificate of disability. Full-time employees must have completed their Introductory Period and should request any leave in writing as far in advance as possible.
(a) Sick Leave/Vacation
If an employee is granted a medical LOA, he/she will be required to use his/her accrued sick and may use his/her vacation time. EBMC will continue to pay for health insurance for employees in accordance with FMLA. Refer to the FMLA section for additional information. Employees are not eligible to receive holiday pay while out on a medical LOA. No sick or vacation hours are accrued during a medical LOA.
(b) Commencement
A medical leave begins on the first day the employee’s doctor certifies that an employee is are unable to work, and ends when the employee’s doctor certifies that an employee is are able to return to work, certifies that the employee is permanently unable to return to work, or after a total of eight weeks of leave, whichever occurs first. The employee’s physician will supply the employee with the form showing the date the disabled began and the estimated time before the employee will be able to return to work. An employee returning from a medical disability leave must present a doctor’s certification that the employee is fit to return to work. Continued absence from work beyond 3 days after the disability ends (as determined by the employee’s physician) will be deemed a voluntary termination of employment.
(c) Return to Work
If returning from a non-work related medical leave, an employee will be offered the same position held at the time his/her leave began, if the position is available. If the former position is not available, a comparable position will be offered. If neither the same nor a comparable position is available, the employee’s return to work will depend on job openings existing at the time of the employee’s scheduled return. EBMC makes no guarantees of reinstatement, and the employee’s return will depend on his/her qualifications for existing openings.
